1. Acceptance of Terms
1.1. These Terms and Conditions form a binding legal agreement between the User and Elfalogix regarding access to and use of the mydmvpermittest website and related services provided through mydmvpermittest.com.
1.2. By accessing the Site, creating an account, or purchasing any paid access, the User confirms acceptance of these Terms. If the User does not agree, use of the Site must stop immediately.
1.3. Use of the Site is permitted from 13 years of age. Users under 18 may use the Site only with the consent and supervision of a parent or legal guardian, and any purchase must be made by, or with the permission of, a parent or legal guardian.
2. Application of Consumer Protection Laws
2.1. The Services may come with rights and protections that cannot be excluded under applicable consumer protection laws in the United States and the User’s state of residence.
2.2. Nothing in these Terms is intended to unlawfully exclude, limit, or modify any rights that cannot be excluded under applicable law. Any non-mandatory warranties or conditions are excluded to the maximum extent permitted by law.
3. Intellectual Property (IP) Rights
3.1. Government / DMV disclaimer: The Site and Services are provided for educational and practice purposes only. mydmvpermittest is not affiliated with, endorsed by, or sponsored by any DMV, state agency, or government authority in the United States.
3.2. All original materials on the Site, including the layout, organization, software, question bank structure, progress tracking systems, user interface, and the specific phrasing and presentation of practice questions and cheat sheets, are protected by intellectual property laws and are owned by Elfalogix or licensed to Elfalogix.
3.3. A limited, non-exclusive, non-transferable, revocable license is granted to the User to access the Site for personal, non-commercial educational purposes only.
3.4. The following conduct is strictly prohibited: copying, reproducing, republishing, distributing, or selling Site content for commercial purposes; sharing or reselling access credentials; attempting to reverse engineer or extract source code or algorithms; scraping content; and using the Site in a way that interferes with security, stability, or other users’ access.
4. The “100% Money-Back Guarantee”
4.1. A conditional 100% Money-Back Guarantee is offered to eligible purchasers who fail an official U.S. DMV written or knowledge permit test for the relevant state or jurisdiction. This guarantee is limited to the amount paid for the eligible paid product purchased on the Site and does not extend to any third-party or government fees.
4.2. Eligibility requires strict satisfaction of all conditions below:
- Eligibility timing: The eligible paid product must be purchased at least 14 days before the official test date.
- Completion: The User must complete 100% of the available revision questions and mock tests for the relevant state or jurisdiction, as reflected by account progress logs.
- Performance: Before sitting the official test, the User must achieve at least 90% on the designated Final Mock Exam or Simulation Exam where such an exam exists on the platform for that state/jurisdiction, or on the highest-level readiness assessment provided.
- Proof of failure: The User must provide reasonable proof of failure of the official DMV test, such as an official score report, official portal result, or other official confirmation showing failure and test date.
- Claim window: The refund claim must be submitted by email to support@mydmvpermittest.com within 30 days of the failed test date.
4.3. The guarantee covers the purchase price paid to Elfalogix only. Government application fees, booking fees, travel costs, printing costs, and any other third-party costs are excluded.
4.4. The guarantee does not apply where the required completion/performance criteria are not met, where the test appointment is missed, where failure results from administrative issues such as missing identification or not meeting test requirements, or where account misuse is detected, including account sharing.
5. Payment, Cancellations & Refunds
5.1. Paid access is provided on a one-time purchase basis unless otherwise stated at checkout. Prices and any applicable taxes are displayed at the time of purchase. Payment processing is handled by secure third-party payment processors such as Stripe or PayPal; full card numbers are not stored by the Site.
5.2. If the Service has a major or material failure under applicable law, the User may be entitled to a remedy such as a refund, replacement access, or compensation consistent with legal requirements.
5.3. Except for valid legal claims or the 100% Money-Back Guarantee described in Section 4, refunds for change of mind are not offered to the maximum extent permitted by law once access has been granted.
6. User Conduct & Account Security
6.1. Access is intended for single-user, personal use. Sharing passwords, allowing multiple people to use one paid account, reselling access, or transferring access to another person is a material breach of these Terms.
6.2. Account suspension or termination may occur immediately where abnormal usage patterns suggest account sharing or misuse, including excessive IP address changes, simultaneous logins, or use of tools intended to mask location or access patterns. Where permitted by law, termination for breach may be without refund.
6.3. If the User submits reviews, comments, feedback, or other content, the User confirms the submission does not infringe third-party rights and does not contain unlawful, abusive, misleading, or harmful material. Permission is granted to display and use submitted content for operating and improving the Site, including displaying reviews, subject to the Privacy Policy.
7. Governing Law & Jurisdiction
7.1. These Terms are governed by the laws of the United States of America, and where applicable, relevant state laws may also apply depending on the User’s place of residence and mandatory legal rights.
7.2. Any disputes arising out of or in connection with these Terms or use of the Site must be brought in a court of competent jurisdiction within the United States, unless applicable law requires a different forum.
7.3. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including this section.
8. Limitation of Liability
8.1. To the maximum extent permitted by law, Elfalogix is not liable for indirect, incidental, special, or consequential losses arising out of or relating to the use of the Site, including loss of data, loss of profits, loss of opportunity, or failure to pass an official DMV test.
8.2. Content and practice tests are provided for study purposes. No guarantee is given that content is error-free, that access will be uninterrupted, or that any official test result will be achieved.
8.3. To the maximum extent permitted by law, total liability for any claim arising out of these Terms is limited to the amount paid for the relevant paid product giving rise to the claim, except where such limitation is not permitted under applicable law.
9. Modification of Terms
9.1. These Terms may be updated at any time. Changes become effective immediately upon posting on the Site. Continued use of the Site after updates constitutes acceptance of the revised Terms.
